Terms of Service

1. Acceptance of Terms

By accessing or using the Apheliox application (the "Service") operated by HexNode Group LLC DBA Apheliox ("we," "our," or "us"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Apheliox is a multi-platform live stream chat monitoring tool. The Service tracks publicly available chat messages across TikTok, Twitch, YouTube, and Kick, archives them, and sends notifications when specified keywords are detected. The Service also supports team collaboration, Excel data exports, Discord bot integrations, live go-live/stream-ended notifications, two-factor authentication, and social sign-in.

3. User Accounts

  • You may create an account using email registration or social sign-in (Google, Discord, Twitch, TikTok).
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You must notify an administrator immediately of any unauthorized use of your account.
  • You may not share your account credentials with others.
  • You may upload a profile photo. You must not upload images that are offensive, infringing, or otherwise inappropriate.

4. Acceptable Use

You agree to use the Service only for its intended purpose and in compliance with all applicable laws. You shall not:

  • Use the Service to harass, stalk, or intimidate any person
  • Attempt to gain unauthorized access to other users' accounts or data
  • Use the Service in any way that violates the terms of service of TikTok, Twitch, YouTube, Kick, or any other monitored platform
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Use the Service for any illegal or unauthorized purpose
  • Abuse rate limits or attempt to overwhelm the Service's infrastructure

5. User Roles and Permissions

Access to features is governed by your assigned role:

  • Super Admins have full access to all features and system settings
  • Admins can manage tracked accounts, users, and global monitored words
  • Managers can view streams, chat messages, mentions, manage their personal monitored words and alerts, and export data

6. Teams

The Service supports collaborative monitoring through teams:

  • Team Owners can create, edit, and delete teams, manage tracked accounts, and invite members
  • Team Admins can manage monitored words and team membership
  • Team Mods can view the team's tracked data

Team invitations are sent via email and expire after 7 days. By accepting an invitation, you agree to these Terms and the team's monitoring scope.

7. Discord Integration

The Service uses a Discord bot to deliver notifications. By inviting the Apheliox bot to your Discord server, you authorize it to read server information (channels, roles) and send messages to your selected channels. You are responsible for ensuring the bot has appropriate permissions in your server. For legacy webhook users, you are responsible for ensuring the webhook URL points to a channel you have authorization to post in.

7a. Live Notifications

The Live Notifications feature periodically checks platform APIs to detect when tracked channels go live or end their streams. Discord notifications are sent and edited automatically. We do not guarantee real-time detection — platform API delays and rate limits may affect notification timing.

7b. Two-Factor Authentication

You may enable two-factor authentication (2FA) via an authenticator app (TOTP) or email-based one-time codes. Recovery codes are provided during setup and should be stored securely. We are not responsible for account lockout resulting from lost 2FA devices or recovery codes.

8. Data and Content

The Service monitors publicly available content across multiple streaming platforms. We do not claim ownership of any content from TikTok, Twitch, YouTube, Kick, or any other monitored platform. All platform content remains the property of its respective creators and is subject to each platform's terms of service.

Data you export from the Service (chat logs, mentions, messages) is your responsibility once downloaded. You agree not to use exported data in ways that violate applicable laws or platform terms.

9. Social Sign-In

When you use social sign-in, you authorize us to access basic profile information (name, email) from the chosen provider. For providers that support it (Twitch, YouTube), we may also request permission to read your follows or subscriptions for the purpose of importing tracked accounts. We do not post to, message, or otherwise interact with your social accounts beyond these stated purposes.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. PLATFORM APIs MAY CHANGE WITHOUT NOTICE, WHICH MAY TEMPORARILY AFFECT MONITORING AVAILABILITY.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HEXNODE GROUP LLC DBA APHELIOX SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO MISSED NOTIFICATIONS, DATA LOSS, OR SERVICE INTERRUPTIONS.

12. Termination

We reserve the right to terminate or suspend your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately.

13. Changes to Terms

We reserve the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the updated Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
